Any representation, warranty, condition or undertaking that would be implied in these Terms & Conditions by legislation, common law, equity, trade, custom or usage is excluded to the maximum extent permitted by law. Nothing in these Terms & Conditions excludes, restricts or modifies any condition, warranty, right or remedy which may be conferred by the Competition and Consumer Act 2010 (Cth) that cannot be excluded, restricted or modified by agreement. To the fullest extent permitted by law, our liability for a breach of a non-excludable condition or warranty is limited, at our option, to, in the case of goods, any one or more of the following:

• the replacement of the goods or the supply of equivalent goods;

• the repair of the goods;

• the payment of the cost of replacing the goods or of acquiring equivalent goods; or

• the payment of the cost of having the goods repaired,

or in the case of services:

• the supplying of the services again; or

• the payment of the cost of having the services supplied again.

You agree to comply with the Conditions of Entry and any other conditions displayed at the front gate or attractions. We may cancel or suspend any product you have purchased, or which has been purchased on your behalf and/or remove you from the premises if you breach any of these Conditions of Entry.

We recommend all visitors download the Village Roadshow Theme Parks App and load their admission “ticket” to gain entry to the parks (other than Australian Outback Spectacular where guests are required to show their ticket purchase confirmation on a mobile device). The holder of a Village Roadshow Annual Pass, Village Roadshow Multi Park Pass or Membership also agrees to load a clear headshot photograph of themselves for identification purposes and present same upon entry failing which entry may be refused.

Passes / Tickets

All passes remain the property of VRTP and are not transferable to another person. Your pass cannot be sold and will be cancelled without refund if used by anyone else. Extensions to the validity of a pass or refunds as a result of limited visitation, suspension, premises or ride closure are not granted (subject to any requirements at law to the contrary).

Exclusions to Admission Passes

• Fast Photo

• Entry to after-hours events at the parks such as Carnivale, Fright Nights, Spooky Nights and White Christmas

• all coin-operated games, lockers and candid and ride photographs and video.

• entry to special events (such as “Festival on the Farm” at Paradise Country) or private functions.

You must pay independently for all food, beverage and merchandise.

If you have purchased an admission pass for someone else then you must make available or known to them these Terms & Conditions and by their attendance they shall be deemed to have accepted same. Where a person purchases an admission pass for a minor the purchaser shall be responsible for the admission pass and is deemed to be the authorised representative for the minor.

We reserve the right to cancel any admission pass and refuse entry where we reasonably believe they have been obtained in an unlawful or improper manner or in breach of these Terms & Conditions. Pass holders who have been refused entry or evicted from Village Roadshow Theme Parks’ properties and surrounds for inappropriate behaviour may have their passes or memberships cancelled.  Cancellations or refunds as a result of limited visitation, suspension, premises, or ride closures are not granted (subject to any requirements at law to the contrary).

We may impose restrictions or limitations on access to the parks, rides, shows and attractions at any time. We may close rides, shows, attractions or the parks on a permanent or temporary basis due to inclement weather, safety, refurbishment, maintenance, acts of God or other reasons.

All admission passes cannot be redeemed for cash, are non-refundable (subject to any requirements under the Australian Consumer Law or other applicable laws), not exchangeable and cannot be resold.

All admission pass prices are in Australian dollars and are inclusive of GST. If you do not plan on using the rides or seeing any shows or attractions but wish to enjoy the surrounds (this includes parents, pregnant women and guardians supervising or waiting for children) you must still pay full price for admission. Pensioner prices are available to Australian and New Zealand Government pension card holders only and a valid and original pension card must be presented at the time of entry.

Subject to the below and any requirements at law to the contrary no extensions to validity periods are allowed.

Ticket authenticity is only guaranteed where tickets are purchased directly from VRTP or an agreed provider. The Privacy Act prohibits VRTP from disclosing patrons' personal information to third parties. Accordingly, Village Roadshow Theme Parks will only discuss specific booking details (including refunds or patron information) with the original purchaser. The re-sale of any admission passes at a premium or for commercial purposes without VRTP prior written consent is a contravention of our conditions of sale. Any admission pass sold in contravention of our conditions of sale may be cancelled without refund and the bearer of the ticket may be denied admission. Accesso is the official ticketing service for events at VRTP. Selected packages are sold through authorised resellers only. Any admission passes sold through unauthorised sales channels may be seized or cancelled without refund or exchange. The bearer of the admission pass may be denied entry. All admission passes booked through a 3rd party channel must abide by the 3rd party's terms and conditions. Unauthorised sales channels include, but not limited to, Wechat, Taobao, eBay and Gumtree.

You may be asked to provide personal information (i.e.: information which is collected and identifiable as relating to you personally) before purchasing any admission pass. All personal information collected will be maintained in accordance with our Privacy Policy and you consent to us retaining and using your personal information in accordance with such policy, a copy of which can be provided upon request. Wet’n’Wild, Australian Outback Spectacular and Paradise Country are now cashless, with card and digital payments only accepted in the venues.

• any materials, ideas or other communications you transmit in any manner and for any reason will not be treated as confidential or proprietary,

• any ideas, concepts, techniques, procedures, methods, systems, video, scripts, music, photographs, designs, plans, charts, or other materials you transmit may be used by VRTP anywhere, anytime, and for any reason whatsoever,

• not to use any obscene, indecent, or offensive language,

• not to place on the Websites any material that is defamatory, abusive, harassing, racist, hateful, encrypted, constitutes junk mail or unauthorized advertising, commercial offers, invades anyone's privacy, or encourages conduct that would constitute a criminal offence, give rise to civil liability, or that otherwise violates any local, federal, national or international law or regulation,

• to use the Websites only for lawful purposes,

• you are responsible for ensuring that any material you provide to the Websites or post on a bulletin board or forum or elsewhere, including but not limited to text, photographs and sound, does not violate the copyright, trademark, trade secret or any other personal or proprietary rights of any third party or is posted with the permission of the owner(s) of such rights,

• not to disrupt, overwhelm, attack, modify or interfere with the Websites or their associated software, hardware and/or servers in any way,

• employees of VRTP and its related bodies corporate, including immediate family members, may not become members of the Websites and cannot enter any competitions promoted on the Websites.

When buying online through the Websites products can only be purchased using a credit or debit card. All credit and debit card purchases are made through a secure payment facility. Your credit or debit card will be debited at the time of ordering. In the unlikely event that you believe any unauthorised use of your card has occurred, please immediately notify VRTP by email and contact your bank through your usual communication method.

The information on the Websites (including prices and product offerings) may change at any time without notice. The availability of rides, shows and attractions shown or referred to on the Websites is subject to change, delay, cancellation or closure due to inclement weather, preventative maintenance, refurbishment or other operational requirements - detailed particulars can be obtained by contacting the relevant theme park directly or by telephoning 13 33 86.

The contents of the Websites, such as graphics, logos, information, text, video clips, material, software or advertisements ("Content") is owned by VRTP unless stated otherwise and protected by Australian and international copyright and trademark law. Without the express permission of VRTP, the Content must not be modified, copied, reproduced, republished, framed, uploaded, posted, transmitted or distributed in any way except as expressly provided on the Websites however you may download, store in cache, display, print and copy material in a complete and unaltered form for your own personal, non-commercial use provided that you:

• keep intact all copyright and trademark notices (see below); &

• do not use the material in any manner that suggests an association with any VRTP products, services or brands.

Provided the above conditions are followed, you may use the material on the Websites for the purposes of research or study provided your use is fair (It is deemed fair to reproduce no more than 10% of the number of words on the Websites and to only use the material for class use or assessment).

General Admission Entry Tickets - Adult, Pensioner and Children - (and any other type of entry ticket described below) are valid only for the date and show booked, failing which it will be deemed void and not able to be used. No change to the seat allocated to each ticket purchased is permitted. Ticket is non-refundable (unless required by law), not exchangeable or transferrable and cannot be resold nor redeemed for cash. Pensioner prices only available to Australian and New Zealand residents. If you wish to change your booking an amendment fee per transaction applies for all date changes which are at all times subject to availability.

General Admission - Children

Free for children 2 years and under (but does not include seat [child to be situated on parent’s lap] nor a meal). General Admission Entry Ticket Children’s rate is applicable for children aged 3 - 13 years inclusive and for children aged 2 years and under where an individual seat and meal is to be served.

Children must be seated with a paying adult (18+).

Top Rail Premium

Free for children 2 years and under (but does not include seat [child to be situated on parent’s lap] nor a meal). Includes entry ticket to Top Rail section of venue plus 1 x pre-show beverage (from selection of draught and packaged beer, glass of premium wine or a souvenir vessel filled with soft drink) and 1 x souvenir photograph.

The Drover's Lounge

Includes entry ticket to Drover’s Lounge section of venue plus four course dinner, accompanied by a premium suite of beverages, 1 x backstage tour and 1 x souvenir photo. Drover’s Lounge seats 12 guests but package does not guarantee exclusive use of the lounge.

CONDITIONS OF ENTRY In accordance with our Conditions of Entry, we reserve the right to deny admission to persons under the age of 18 unless accompanied by a supervising companion aged 18 years or over. Adults and carers are responsible for persons under their supervision.

A Book a Day Single Day Ticket to Warner Bros. Movie World, Sea World, or Wet’n’Wild (“the Park”) entitles the holder to admission to the selected Park on the specific date chosen at the time of purchase, during normal advertised operating hours. The ticket includes access to all rides, shows and attractions; however, all food, beverage, merchandise and any separately ticketed experiences must be purchased independently.

Children under 3 years of age do not require a ticket.

Single Day Ticket prices vary depending on the date chosen, due to seasonal demand, operational and maintenance schedules. There are no blackout dates- guests can select any available date for their visit.

A Single Day Ticket to Warner Bros. Movie World, Sea World, Wet’n’Wild (“the Parks”) entitles admission during normal advertised operating hours and covers all rides, shows and attractions (you must pay independently for all food, beverage and merchandise) BUT EXCLUDES those items set out above in Exclusions to Admission Passes. Children under the age of 3 years old do not require a ticket.

Pass must be used within 12 months from the date of purchase (failing which it will be deemed void and not able to be used) and is valid on the day of use only.

A Single Day Multi Park Ticket to Warner Bros. Movie World, Sea World, Wet’n’Wild and Paradise Country (“the Parks”) entitles the holder to admission to all four Parks on one (1) calendar day only, during their normal advertised operating hours. The ticket includes access to all rides, shows and attractions; however, all food, beverage, merchandise and any separately ticketed experiences must be purchased independently. This ticket EXCLUDES all items listed as set out above in Exclusions to Admission Passes.

Children under 3 years of age do not require a ticket.

The ticket must be used within 12 months from the date of purchase. If not redeemed within this period, the ticket will be deemed void and unable to be used. Once redeemed, the ticket is valid for that day of use only.

The ticket is non-refundable, non-transferable and cannot be redeemed for cash. Standard conditions of entry apply for each Park.

A Single Day Flexi Ticket to Warner Bros. Movie World, Sea World, Wet’n’Wild or Paradise Country (“the Park”) entitles the holder to admission to the selected Park within 3 months from the date of purchase, during normal advertised operating hours. The ticket includes access to all rides, shows and attractions; however, all food, beverage, merchandise and any separately ticketed experiences must be purchased independently.

Event tickets must be pre-booked online when available. We will notify Premium Annual Pass holders by email when pre-booking opens. Whilst Sea World takes all reasonable precautions to ensure the health and safety of guests and staff, participants should be aware that close encounters with animals will always involve a degree of unpredictability. • release Sea World to the full extent permitted by law from any claim for personal injury, loss or damage arising from their participation in Animal Adventure programs.

Participants:

• acknowledge that they will be entering an environment housing animals and whilst we take all reasonable precautions to ensure the health and safety of guests and staff, close encounters with animals will always involve a degree of unpredictability, where quick reaction and strict attention to directions from staff are essential.

• release VRTP (to the fullest extent permitted by law) from any claim for personal injury, loss or damage arising from their participation in any Animal Adventures program.

• agree to comply with all lawful directions that we make in respect of their participation.

Certain criteria to ensure the safety of guests, staff and animals must be met to participate in each of the programs. All participation is subject to final assessment by our Marine Science’s staff member at the time of attendance. If at any time prior to the program commencing or during the program, a participant is assessed by staff as not able to fulfil the criteria, they will be directed to leave the program whereupon no refund will be given [subject to any requirements at law to the contrary].

Cancellations & Refunds

Participants acknowledge:

• Sea World may at its sole discretion cancel any Animal Adventure program if the Marine Science’s staff member is of the opinion that extreme weather of other conditions makes it impossible for the program to be held. In the event of such cancellations, participants will either be rebooked into another Animal Adventures program (subject to program availability) or a gift card of the program costs paid. Gift cards will only be paid to the person who made the booking in the same manner as paid. Gift cards are valid for up to 3 years maximum.

• Animal Adventures bookings are non-transferable, not to be re-sold and not redeemable for cash.

• Animal Adventures are valid only for the date, time and program specified.

• must have footwear [thongs are acceptable] and unless accompanied by an adult must be over 110cm tall (without shoes) and over 5 yrs. Children under 5 yrs or 110cm (without shoes) may participate with a paying adult but will not be permitted to touch the seal.

• must be able to speak and/or understand English, or have a translator participate in the program with them (there are no complimentary programs for translators). Persons acting as a translator must advise staff at the start of the program and must satisfy all criteria. Participants must follow directions quickly to the satisfaction of staff, be able to quickly exit the pool area unassisted and must have controlled motor movement.

• Must check into the Dockside Photo Lab no less than 1 hour prior to the photo session time to receive their wristband & ensure that criteria have been met. It is here that participants will receive details on the meeting location.

• Will be required to step down onto a sandy beach area and will be required to wear appropriate clothing as they may get splashed & get into water that may be up to their knees.

There are no complimentary programs for companions. Unaccompanied participants must be aged 5 years or over and be a minimum height of 110cm. If the participant does not meet the height restriction, they will not be able to participate and will not be eligible for a refund (subject to any requirements at law to the contrary).

• must be able to speak and/or understand English, or have a translator participate in the program with them. There are no complimentary programs for translators. Persons acting as a translator must advise staff at the start of the program. Translators must satisfy all criteria;

• will be required to step down 60cm on to a submerged platform and will be required to wear appropriate clothing as they may get splashed;

There are a limited number of general admission tickets available for purchase and redemption to the Sea World Carnivale special event [“Event”]. The Event is a separate ticketed event outside of the park’s normal trading hours. Other than as set out below, guests are NOT entitled to entry unless they separately purchase an Event general admission ticket.

GROUP BOOKING AGREEMENT Terms and Conditions The details set out in the Booking Form and these terms and conditions govern the booking and provision of a group function between Village Roadshow Theme Parks Pty Ltd ABN 60 010 919 623 [“we” or “us”] and the party/s named in the Booking Form [“you”] and are governed by the laws in force in the State of Queensland. The Terms and Conditions for purchase of products set out at www.themeparks.com.au shall also apply so far as they are applicable. 1. Confirmation of Tentative Booking To confirm your tentative booking, you MUST make payment for twenty (20) or more full paying package guests whereupon it is deemed that you accept these Terms and Conditions and agree to be bound by same. 2. Cancellation / Refunds A confirmed booking may be cancelled by notice in writing via email: a) by us if you do not pay monies to us as required by these terms and conditions, if you conduct the function in a manner that we deem to be unsafe or if you breach these terms and conditions whereupon any monies you have paid to us shall be forfeited to us in full unless otherwise agreed; b) by us if events beyond our reasonable control prevent us holding the function or if upon our review of operational procedures for the proposed function we have any safety concerns whereupon all monies you have paid to us shall be immediately refunded in full to you; or c) by you at any time whereupon any monies you have paid to us shall be forfeited to us in full unless you give us notice more than two (2) weeks before the date of the function in which case we shall refund all monies to you. Food (excluding commercially prepared food), non-alcoholic beverages within plastic or tin containers, eskies and coolers are permitted at Wet’n’Wild. 7. Electrical If you wish to bring into the premises any portable electrical equipment for use at the function then same must first be inspected by us and (subject to it being deemed safe and acceptable for use) electrically tested and tagged by us. 8. Entry Conditions All persons attending the function agree to comply with the Entry Conditions (as appears in notices located at the main entry to the premises) which shall apply and are not waived, varied or in any other way mitigated by the terms contained herein. 9. Closure We may impose restrictions or limitations on access to the parks, rides, shows and attractions at any time. We may close rides, shows, attractions or the parks on a permanent or temporary basis due to inclement weather, safety, refurbishment, maintenance, Acts of God or other reasons.

Booking Agreement – School Excursions and Educational Programs Terms and Conditions The details set out in the Booking Form and these terms and conditions govern the booking and provision of school excursions, educational programs and associated meal offerings between Village Roadshow Theme Parks Pty Ltd ABN 60 010 919 623 [“we” or “us”] and the Booking Company (if applicable) or School named in the Booking Form [“you”] and are governed by the laws in force in the State of Queensland. The Terms and Conditions for purchase of products set out at www.themeparks.com.au shall also apply so far as they are applicable. 1. Booking You must fully complete the Booking Form and sent it back to us. We will then issue a confirmation email to you that includes the quoted total cost for the booking (which shall be for a minimum of 10 full paying students and is inclusive of any Goods & Services Tax) and payment method. Where the payment method advised to you is not the preferred payment method you have selected in the Booking Form you must advise us without delay if you do not agree to such payment method failing which it shall be deemed that you agree to same. 2. Payment Where you are required to pay prior to the booked visit day you must pay the quoted total cost for the booking advise in the confirmation email to you without delay. Where you intend to pay for the booking by credit card or cash on the booked visit day you must pay the cost of any meal vouchers and educational program participation as set out in the confirmation email at least 48 hours prior to the booked visit day. Admission tickets and meal vouchers will not be issued until full payment has been received (other than where paying by invoice). Should payment be made by direct deposit, tickets and vouchers will not be issued until the funds have been cleared in our bank account. A full breakdown of final group numbers including the total number of paying students, bona fide teachers, PWD carers, accompanying adults and current valid passholders# must be confirmed at the time of entry on the booked visit day (and where you have been approved to pay on invoice, confirmed by the teacher in charge who shall be required to complete applicable documentation). A tax invoice will be provided to you in respect of associated taxable supplies. Where you have paid the quoted total cost of the booking prior to the booked visit day and the final group numbers confirmed at the time of entry on the booked visit day are:- a) more, you must pay the balance we inform you is due and owing at that time b) less, upon us verifying not all admission tickets have been used, monies you have previously paid to us in respect of those not in attendance shall be refunded in full to you. *Passes include annual passes, memberships, and pre-purchased passes. Passholder must be sighted with their valid pass (in physical form, on the VRTP app or a scanned copy if unable to access the physical pass or no access to a smart phone - the screenshot/scanned copy must be clear and legible) by our staff on the day. Where you are paying on invoice should the holder’s pass be invalid or not presented on the day a charge shall be levied for such student at the applicable entry rate and no refund will be issued. 3. Cancellation / Refunds A booking may be cancelled by notice in writing via email: a) by us if you do not pay monies to us in full where due on or before the booked visit day or if you breach these terms and conditions whereupon any monies you have paid to us shall be forfeited to us unless otherwise agreed; b) by us if events beyond our reasonable control prevent us allowing entry to the park or providing the educational program that has been booked or if upon our review of operational procedures we have any safety concerns whereupon all monies you have paid to us shall be immediately refunded in full to you; or c) by you at any time whereupon any monies you have paid to us shall be forfeited to us in full unless you give us notice of cancellation more than 24 hours before the booked visit day (and notice of cancellation 48 hours or more in respect of educational programs and meal vouchers) in which case we shall refund all monies to you. Subject to clause 2, any admission tickets or meal vouchers issued to you that are not used on the booked visit day are non-refundable (subject to any requirements at law to the contrary) and not able to be used on another date nor sold to anyone. 4. Educational Programs *Minimum of 10 students per school group booking is required. Our educational programs are Australian curriculum aligned and available for each year level. You must ensure that teachers review program specific schedules at www.themeparks.com.au/education prior to the booked visit day online. Educational programs, schedules and content are subject to availability and are subject to change without notice. Per student fees apply to selected Education Programs as detailed in the park specific Booking Form. Participation in Sea World Tropical Reef Snorkels incurs additional fees where the activity is included in the educational program or booked as an add on component to another educational program - such fees apply to all participants (including teachers) who must satisfy participation criteria including minimum age of 8 years. • You will need to find the missing sea creature from the list and fill in details as requested to enter the competition

Entrants may only enter once.
